THE OLD FORMAT OF EMPLOYMENT CONTRACTS:
The relations between an employer and an employee are regulated by the Federal Law No. 33 of 2021, called the UAE Labour Law. Previously, the Federal Law No. of 1980 regulated labour relations. The law defines the rights of employees in detail and prohibits the exploitation of employees by their employers. The law also forbids all types of discrimination. There are two categories of labour contracts under the Dubai employment law.
Unlimited Contract:
The unlimited contract has a starting date but does not have an ending date. It is a long-term contract that can be terminated with a mutual agreement between the employee and the employer with a notice of termination given 30 days before the termination.
Limited Contract:
The limited contract has a precise starting and ending date. Usually, the fixed term in the case of a limited contract is two or three years. In the case of foreign nationals, the term of the contract is usually dependent on an individual’s residency visa. The contract can be renewed by mutual agreement between the employee and the employer before the termination of the contract. The Law Applies to all individuals who work in the private sector in Dubai, except for the following individuals:
1. Employees of the federal and local governments of the United Arab Emirates
2. Members of the armed forces, employees of the police force, and security personnel
3. Domestic workers
The presence of a large number of foreign nationals in Dubai leads to an increase in the number of potential employees which sometimes prompts employers to exploit their employees. It is usually advisable to get an employment contract reviewed by a lawyer who specialises in employment and labour laws before signing. Getting the employment contract reviewed protects an employee from being bound by a contract that may exploit the employee in any way.
THE OLD FORMAT OF EMPLOYMENT CONTRACTS:
